Introduction and definition of terms

These general terms and conditions (hereinafter referred to as "GTC") govern the legal relationship between Carbonseats s.r.o. (hereinafter referred to as "Carbonseats") and any individual or legal entity (hereinafter referred to as the "customer") who purchases goods through the online store located at www.carbonseats.com ("e-shop").

These GTC form an integral part of any purchase contract concluded between Carbonseats and the customer via the e-shop.

Unless the context indicates otherwise, the following terms shall have the meanings defined below:

• e-shop – the online store operated at www.carbonseats.com for the display and sale of goods.
• order – a completed and submitted transaction by the customer to purchase goods.
• cart – the e-shop feature that allows the customer to add or remove goods before submitting an order.
• invoice – a tax document issued by Carbonseats confirming the sale and payment details.
• goods – carbon fiber seats and mirrors for Ferrari vehicles offered for sale by Carbonseats via the e-shop.
• purchase contract – a legally binding agreement concluded between Carbonseats and the customer for the sale of goods through the e-shop.
• contract – refers to the purchase contract as defined above.
• personal data – any information relating to an identifiable individual as defined by applicable data protection laws.
• consumer – a natural person who acts outside their business or trade when entering into a purchase contract.

Subject of business activity

Carbonseats is engaged in the online sale of high-quality carbon fiber car seats and mirrors, exclusively designed for Ferrari vehicles. Carbonseats does not provide services, installation, customization, or refinishing. All goods are sold as finished products via the e-shop.

Order process and conclusion of the purchase contract

Customers can select goods through the e-shop by browsing available products and adding them to the cart. Once all desired items are selected, the customer proceeds to checkout, where they provide necessary billing and shipping information, choose a delivery method, and select a payment option.

Before completing the order, the customer confirms they have read and accepted these GTC and the personal data processing policy. By clicking the "Place order" button, the customer enters into a binding purchase contract with an obligation to pay.

Once the order is submitted, an order confirmation will be sent by email. The purchase contract is concluded upon the issuance of this confirmation.

Prices, payment, and shipping

The prices of goods are displayed in the e-shop and are final, including applicable VAT unless stated otherwise.

Accepted payment methods include:

• Credit card via payment gateway
• Bank transfer (in advance)

Goods are shipped only after the full payment has been received.

Shipping costs are shown during checkout and vary depending on the shipping method and destination. The customer is responsible for these costs. Carbonseats uses external shipping providers, and shipping times are estimated but not guaranteed.

Delivery and acceptance

Once payment is received, Carbonseats will prepare and dispatch the goods to the address specified by the customer.

The customer is obliged to accept delivery. Any failure to accept delivery may result in return shipping charges, storage costs, or cancellation of the order. Risk of loss or damage transfers to the customer upon delivery.

Right of withdrawal (for consumers)

Consumers (non-business individuals) have the right to withdraw from the purchase contract without giving any reason within 14 days of receiving the goods.

The right of withdrawal does not apply if:

• the goods were customized or modified based on the consumer’s specific request;
• the goods were unsealed and are not suitable for return for hygiene reasons.

To exercise the right of withdrawal, the consumer must notify Carbonseats in writing (e.g., email) of their intention to withdraw. A model withdrawal form is included at the end of these GTC.

The goods must be returned to Carbonseats at the customer’s expense within 14 days of withdrawal, unused and in their original condition. Upon receipt of the returned goods, Carbonseats will refund the purchase price and the basic cost of shipping (if applicable) within 14 days.

Claims for defective goods

Carbonseats guarantees that the goods will be free from defects upon delivery.

If a defect is discovered, the customer must notify Carbonseats without undue delay. The customer may request:

• delivery of a new, defect-free item,
• a reasonable discount, or
• a refund (in justified cases).

The warranty does not apply to:

• normal wear and tear,
• defects caused by misuse, improper installation, or modification,
• defects caused by external damage after delivery.

Carbonseats will respond to all claims within 30 days from the date of receiving the complaint. For consumers, Carbonseats will provide written confirmation of the claim and its resolution.

Limitation of liability

Carbonseats is not liable for any indirect, incidental, or consequential damages arising from the use of goods. The total liability of Carbonseats is limited to the purchase price paid by the customer for the relevant goods.

Carbonseats is not responsible for compatibility issues, installation failures, or damages resulting from improper handling or use of the goods.

Personal data protection

Carbonseats processes personal data in accordance with applicable data protection laws and its personal data processing policy, which is available on the e-shop. Customers’ data is used solely for the purpose of fulfilling orders and legal obligations.

Dispute resolution

In the event of a consumer dispute that cannot be resolved by mutual agreement, the consumer may submit a proposal for out-of-court settlement to the relevant consumer protection authority in their country of residence or use the European Commission's online dispute resolution platform:

Final provisions

These GTC are governed by the laws of the Czech Republic or the relevant jurisdiction of Carbonseats' incorporation.

Carbonseats reserves the right to amend these GTC at any time. The version of the GTC valid at the time of order placement shall apply to that order.

By submitting an order via the e-shop, the customer confirms they have read, understood, and agreed to these GTC.
